On February 28, 2020, the Supreme Court of Tennessee, in Willeford v. Klepper, et al., invalidated Tenn. Code Ann. §29-26-121(f) (permitting health care defendants to apply for a QPO for ex parte treating provider interviews) as enacted, but upheld an elided version of the statute making it discretionary rather than mandatory. In this CLE, Health Care Section Co-Chair (and Willeford counsel for Appellee Livingston Regional Hospital) Chris Vrettos will cover the rationale behind the majority’s opinion and the implications of the decision for future practice.
