The field of health economics has developed tools that we routinely use to assess the reasonable value of medical services and technology, yet these tools are underutilized in litigation. We will provide an in-depth discussion of: (1) why should we worry more about medical losses?; (2) the problem of the abyss between medical charges/bills and reasonable value; (3) how courts typically distinguish between billed charges and reasonable value (in general and in TN); and (4) what we can do about it—how to use simple methods from economics and health economics to calculate reasonable value of life care plans and past medical billing.
